Terms of service

1. Provider and scope

BuildMy.Agency is operated by Christian Weninger, Badgasse 103, 2831 Scheiblingkirchen, Austria ("I", "me"). These terms apply to every use of the website and the application. Deviating terms of the customer do not apply unless I agree in writing.

2. The service

BuildMy.Agency is a software service that helps you find local businesses without a website, generate demo websites, create and dispatch printed letters, and manage the resulting client relationships. The service is a tool: it does not guarantee leads, replies, clients or income. Any forecast, calculator or example figure shown is an illustration based on assumptions you choose, not a promise of results.

3. Account

You need an account to use the application. You must provide accurate details, keep your credentials confidential and are responsible for activity under your account. Accounts are for business use; the service is aimed at entrepreneurs and agencies, not consumers acting for private purposes.

4. Plans, packages and prices

Plans are billed monthly in advance: Starter $79 with 100 prospect packages, Growth $149 with 250 packages and Scale $299 with 600 packages. One prospect package covers one lead, one generated demo website and one letter document. All prices are in US dollars. Applicable tax is calculated and shown at checkout.

Packages reset with each billing period and unused packages do not carry over. The first prospect package is free when you create an account. Physical mailing is charged separately at $1.99 per letter, only when a letter is actually mailed, or at your own provider's rates if you connect your own mail account.

5. Term, renewal and cancellation

A subscription runs for one month and renews automatically until cancelled. You can cancel at any time in the billing area; access and remaining packages stay available until the end of the paid period, after which the plan ends and no further charge is made. Fees already paid for a started period are not refunded, except where the law requires it. I may change prices with at least 30 days' notice before the next renewal.

6. Your responsibilities when contacting businesses

You decide who to contact and what to send. You are responsible for the content of your letters, offers and demo websites, for complying with direct-marketing, competition, trademark and data-protection rules in the recipient's country, and for honouring opt-out requests. You may not use the service for misleading claims, impersonation, unlawful, harassing or deceptive outreach.

7. Acceptable use

You may not attempt to circumvent package limits, rate limits or security measures, reverse-engineer the service, resell access to the application itself, use automated scripts to extract data in bulk, or submit instructions intended to make the AI produce harmful, infringing or executable content. I may suspend an account that breaches these rules or endangers the service.

8. AI-generated content

Demo websites, letter drafts and offer texts are generated by AI at your request. Output can be inaccurate and must be reviewed before you use it. You are responsible for the material you send or publish. Subject to payment, you receive the rights needed to use the output you generate for your own commercial outreach and client work. Imagery supplied by third-party stock sources remains subject to that source's licence.

9. Availability

I aim for high availability but do not warrant uninterrupted operation. Maintenance, third-party outages and force majeure can interrupt the service. Features may be added, changed or removed as the product develops, provided the core function of your plan is preserved.

10. Liability

I am liable without limitation for intent and gross negligence and for personal injury. For slight negligence I am liable only for breach of an essential contractual obligation and limited to the foreseeable damage typical for this type of contract, capped at the fees you paid in the twelve months before the event. Liability for lost profit, lost leads, lost clients and indirect damage is excluded to the extent permitted by law. Mandatory statutory liability remains unaffected.

11. Third-party services

Printing and mail dispatch, payments, business data and AI generation are performed by third-party providers. Delivery times, postage and print quality are governed by the respective provider. I am not liable for postal delays or non-delivery.

12. Termination by me

I may terminate the contract with 30 days' notice to the end of a billing period, and immediately for serious breach of these terms. On termination your access ends; you can export your data beforehand on request.

13. Changes to these terms

I may amend these terms for legal or product reasons. You will be informed at least 30 days before the change takes effect; continued use after that date counts as acceptance, and you may cancel before it applies.

14. Applicable law and venue

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For business customers, the exclusive place of jurisdiction is the court with subject-matter competence for 2831 Scheiblingkirchen, Austria. For consumers, the statutory places of jurisdiction and mandatory consumer protection of their country of residence remain unaffected.
